Public Transportation Passengers

My office has had success representing passengers who use public transportation such as the Massachusetts Bay Commuter Rail, and the MBTA. One particular client was waiting on an icy platform for a commuter rail train during a cold, snowy January morning. Due to the inclement weather, the commuter rail system experienced lengthy delays while passengers waited on the snowy, icy platform. When the train finally arrived, there were five (5) cars, but only the front car had room for passengers. Those passengers waiting on the platform had to hurry through the snow and ice for the limited space available on the one and only car that was allowing passengers to board. Our client slipped and fell on the snow and ice as he attempted to board. He sustained serious bodily injuries as a result of his fall. The platform had not been salted or sanded for safety. Consequently, our office made a claim for damages against the Massachusetts Bay Commuter Rail which was successful. The Massachusetts Bay Commuter Rail was at fault and paid our client’s medical bills and lost wages. The Massachusetts Bay Commuter Rail also made a substantial payment to our client to compensate him for his pain and suffering during the period of time he was totally disabled, and for his lost wages.

Dental Injuries

During the winter of 2011, a man was driving his car to work on a highway with one lane in each direction. Suddenly and with no warning, large slabs of ice and snow from the roof of an oncoming tractor-trailer truck came crashing through his windshield causing him to lose control of his vehicle. The slabs of snow and ice that came through the windshield struck the driver in the mouth causing severe dental injuries including fractured teeth. Company policy required the truck driver to clean the snow and ice from the roof of the truck prior to taking it onto a public roadway. Security camera footage from the facility where the tractor-trailer truck was picked up that morning showed the truck exiting the facility with several inches of ice and snow on the roof.

Products Liability

Last fall, a client came into my office carrying a glass bottle of beer with a jagged opening on the top. The client had opened the bottle of beer and began sipping directly from the beer bottle. Immediately, he received a cut on his upper lip, and he ingested shards of glass. I advised him to see a gastroenterologist who then discovered, through diagnostic studies, rectal bleeding caused by the ingested shards of glass that came from the bottle. I initiated a claim for “damages” and negotiated a substantial monetary settlement for the client.

Slip And Fall Accidents Due To Ice And Snow

In the interest of public safety, on July 26, 2010, the Massachusetts Supreme Judicial Court issued a historic ruling, changing the law governing snow and ice cases. From July 26, 2010 onward, property owners have a duty of reasonable care that is owed to lawful visitors to remove snow and ice just like any other hazard.

The snow and ice removal efforts that are expected of a property owner will depend on the following:

1. The amount of foot traffic reasonably expected.

2. The magnitude of risk reasonably feared.

3. The burden and expense of snow and ice removal.

Therefore, the owner of a single family house is expected to remove snow and ice, but more effort is expected from the owner of the shopping mall with respect to the parking lot and sidewalks used to enter and exit the mall itself. Obviously, a mall parking lot will contain more ice and snow than the entrance to a single family house and there will be more foot traffic at a shopping mall. Reasonable efforts to make the property safe for visitors / customers would be greater for the mall owner than the owner of the single family house.

Under this approach, a jury, or a judge sitting without a jury will determine which snow and ice removal methods are reasonable in light of the expense they impose on the landowner and the probability and seriousness of the foreseeable harm to others.

I. Employee / Workers Compensation
